GENERAL INFORMATION
The regulations of the Amber 77 online store specify the terms and conditions of order fulfillment placed via the website https://www.amber77.com run by Amber 77 Anna Piwoni-Piórewicz with its registered office at ul. Limbowa 9, Gdynia 81-520, NIP 9581531671, REGON 388746641.
The Seller may communicate with the Buyer, and the Buyer with the Seller, via e-mail (shop@amber77.com) or by mail: Amber 77 Anna Piwoni-Piórewicz, ul. Limbowa 9, 81-520 Gdynia.
The condition for ordering Goods and conducting a sales transaction is completing the order form and accepting the Regulations.
To use the store and conclude a sales agreement, it is necessary to have devices that allow access to the Internet. Costs resulting from the use of the Internet by the Buyer are personally borne by him.
The subject of sale are the Goods presented by the Seller on the Store website at the time of placing the Order. All Goods presented in the Store are new, unused and free from defects. The Seller reserves the right to change the price of the Goods, introduce and withdraw Goods, grant discounts on individual Goods and conduct and cancel promotions. However, these changes do not apply to Orders that have been placed. The Seller's offer in the Store is valid worldwide.
The prices of Goods presented in the Store include VAT. The price given in the order form is binding at the time of placing the order.
The availability of information about the Product on the Online Store website does not imply the availability of this Product and the possibility of fulfilling the order.
The Seller does not exclude the possibility of temporarily suspending the availability of the Online Store in the event of the need to carry out maintenance.
PLACING ORDERS
The Buyer may place orders in the Store 24 hours a day, 7 days a week via the website www.amber77.com. Orders placed on non-working days will be processed within 3 working days from the moment of posting the payment. The Seller is not responsible for failure to deliver an e-mail message about placing an Order due to reasons beyond the control of amber77.com, e.g. such as the Customer providing an incorrect e-mail address.
The Buyer must pay for the order, including shipping costs, within 7 calendar days of concluding the sales contract. After this time, the Seller's offer is not binding.
Modification or cancellation of the Order is possible until the Order has not yet been sent. The Buyer can perform the above actions by contacting the Seller. This does not in any way affect the Consumer's rights to withdraw from the contract within 7 days of receiving the Goods.
ORDER PROCESSING
The condition for the execution of the Order placed by the Buyer is to provide true personal and contact data when filling out the Order form (enabling verification and confirmation of acceptance of the Order).
The Seller may, in situations requiring it, request confirmation of the data provided by an appropriate document and make the provision of services and use of the Store dependent on it.
In the ordering process, the Customer provides the full address to which the ordered items should be sent. In the event of any changes to the data, the Buyer is obliged to update it immediately. The Buyer is responsible for the consequences of providing outdated data.
The order is fulfilled after the payment of the price is credited to the Seller's account. In exceptional cases, the Seller may fulfill the order urgently based on the proof of bank transfer presented by the Buyer.
If the order form is insufficiently or incorrectly filled out by the Customer, the Seller will attempt to contact the Customer to confirm the order. If the Order cannot be confirmed within 7 days due to the lack of possibility to contact the Buyer, the Seller's offer is not binding.
The place of performance by the Seller is the delivery address indicated by the Buyer in the Order placement procedure.
PAYMENT METHODS
The Seller provides the following payment methods:
- Settlements for credit card and e-transfer transactions are carried out via Tpay and PayPal.
- Prepayment by traditional transfer to the bank account of Santander Bank Polska SA.
All transfer costs are borne by the sender of the transfer.

COST, DELIVERY AND DELIVERY METHODS
Information about delivery costs is visible during the ordering process. Delivery costs are added to the price of the goods and are borne by the Buyer.
The Seller delivers the ordered Goods free of charge via the DHL courier company for Orders above PLN 500 within Poland and free of charge via Poczta Polska for Orders above EUR 200 outside Poland.
The goods are shipped within 3 business days from the moment the payment is credited to the Seller's account. In the event of an extension of the shipping period, the Seller is obliged to contact the Customer.
The average order processing time, including delivery, is 4-7 business days and depends on the selected shipping method. Outside Poland, the order processing time, including delivery, is estimated at 7 to 14 business days, but this time depends on the selected country and may be longer.
Buyer must pay any customs duties and import taxes that may apply. Seller is not responsible for delays caused by customs procedures.
When accepting a parcel delivered by a courier or post office, the Buyer is obliged to examine it (pursuant to art. 545 § 2 of the Civil Code). In the event of damage to the parcel, the Seller recommends drawing up a damage report in the presence of the delivery person and immediately informing the Seller. The lack of a damage report may make it difficult for the Consumer to pursue any claims against the Seller and to identify the person responsible for the damage to the parcel.
The Seller shall not be liable to the Buyer who is not a Consumer for delays in the delivery of the ordered Goods if the delay occurred due to reasons attributable to the entity providing courier services.
WARRANTY AND COMPLAINT
The Seller is obliged to deliver to the Buyer goods free from defects. The Buyer has the right to file a complaint due to a defect in the goods. If after receiving the purchased Item the Buyer finds defects in it, he should immediately contact the Seller.
Complaints may be submitted in writing by traditional mail to the following address: Amber 77 Anna Piwoni-Piórewicz, Limbowa 9, 80-520 Gdynia, Poland or by e-mail: shop@amber77.com as a signed and scanned document.
When filing a complaint, the Seller recommends providing the Buyer's contact details, the name of the item and a detailed description of the reasons for the complaint and the demands towards the Seller, as well as attaching a sales document or a photocopy thereof. If it is necessary to supplement any gaps in the complaint, the Seller will contact the Buyer immediately.
Complaints are considered within 14 working days of the Seller receiving the complained goods.
The Seller may repair or replace defective Goods with other Goods. The Seller may refuse to satisfy the Consumer's request if it is impossible to bring the defective Goods into conformity with the Agreement in the manner chosen by the Consumer, or in comparison with another possible way of bringing the item into conformity with the Agreement, it requires excessive costs.
The consumer may request a reduction in the price of the defective product. In the event of a price reduction, the reduced price should be in such proportion to the price resulting from the Agreement, in which the value of the defective product remains to the value of the defect-free product. It is not possible to file a complaint regarding defects and faults for which the price was reduced.
If it is not possible to repair the Goods, the Buyer will be refunded the price of the Goods (including shipping costs and the cost of returning the goods to the Seller. The value of the refunded shipping costs will correspond to the shipping option selected when placing the order).
The consumer's rights resulting from a defect in the Goods do not limit the Buyer's rights resulting from the warranty granted by the guarantor - on the terms indicated in the warranty document (if such a document is attached to the goods).
In the event of non-delivery or damage to a shipment sent via Poczta Polska, the complaint procedure is conducted in accordance with the regulations of Poczta Polska (http://www.poczta-polska.pl/reklamacje).
In the event of non-delivery or damage to a shipment sent by a carrier other than Poczta Polska, the complaint procedures appropriate to the given shipping company apply.
If the shipment does not reach the recipient due to an incorrect or incomplete recipient's address (also when the entity delivering the shipment considers the address provided to be insufficient or incorrect), all costs associated with delivery (including re-delivery) of the item shall be borne by the Buyer.
Products that are made to the individual order of the Buyer, or in which any changes have been made at the Buyer's request in relation to the design and description presented on the Gallery pages, are not subject to complaint due to the product not being in accordance with the description and photos.
The complainant may also pursue his/her rights on general terms, using court methods of pursuing claims, and in the event of consent of both parties, also out-of-court methods of handling complaints and pursuing claims. At http://ec.europa.eu/consumers/odr/ there is an ODR platform - online resolution of disputes between consumers and traders.
WITHDRAWAL FROM THE CONTRACT
In accordance with the law, the Buyer may withdraw from the purchase and sale agreement without giving any reason within 14 calendar days from the date of receipt of the goods by the Buyer.
This statement should be sent (no later than 14 calendar days from receipt of the shipment) to the e-mail address shop@amber77.com as a signed and scanned document, or by traditional mail to the following address: Amber 77 Anna Piwoni-Piórewicz, Limbowa 9, 80-520 Gdynia.
The returned item should be sent to the following address: Amber 77 Anna Piwoni-Piórewicz, Limbowa 9, 80-520 Gdynia. The costs associated with returning the Goods are borne by the Buyer returning the Goods. Cash on delivery will not be accepted. The Goods should be sent back at the same time as sending the declaration of withdrawal from the contract.
It is recommended that when returning Goods, the Buyer sends the item by registered mail (e.g. registered mail), securely packaged.
The Seller shall withhold the refund until the Seller receives the Goods. The Buyer is obliged to return the item in an unchanged condition. The Buyer is liable for reducing the value of the Item. In the event of a positive decision on the withdrawal from the contract, the Seller shall return the value of the goods (excluding shipping costs) to the Consumer immediately, and in any case no later than 7 business days from the day on which the Seller received the returned goods. The refund is made by bank transfer.
The receipt should be sent back with the Goods. If the proof of purchase is an invoice, the buyer is obliged to attach a signed correction invoice.
PERSONAL DATA PROTECTION
By completing the Order/Registration form, the Buyer declares that the data provided therein is consistent with the facts.
By completing the Order/Registration form, the Buyer consents to the processing of the data provided for the purpose of executing the contract of sale of the Goods by the Seller, who is also the data administrator, in accordance with the provisions of the Act of 29 August 1997 on the protection of personal data.
Personal data contained in the Seller's database are not transferred to entities not participating in the execution of the Goods sales contract.
Providing personal data is voluntary, however, failure to consent to the processing of personal data prevents the sale of the Buyer's Goods.

FINAL PROVISIONS
Agreements concluded through the Amber 77 Store are concluded in accordance with Polish law and in Polish.
In matters not regulated by the Regulations, the provisions of generally applicable law shall apply, including in particular the provisions of the Civil Code and the Act of 30 May 2014 on consumer rights. The Regulations do not exclude or limit any rights of the Consumer, which are granted to them under mandatory provisions of law.
In the event of a conflict between the provisions of the Regulations and the mandatory provisions of law that grant rights to Consumers, these provisions shall prevail.
The Seller reserves the right to change these Regulations. The change to the regulations becomes effective on the date indicated by the Seller, no shorter than 7 days from the moment the changed regulations are made available on the Online Store website. Orders placed by the Customer/Consumer before the changes to the Regulations come into effect are fulfilled according to the previous provisions of the Regulations.
Disputes arising between the Seller and the Customer who is also a Consumer shall be submitted to the competent common courts. Disputes arising between the Seller and the Customer who is not also a Consumer shall be submitted to the competent court with jurisdiction over the Seller's registered office.
In matters not regulated in these Terms and Conditions, the provisions of: the Civil Code; the Act on the provision of electronic services of 18 July 2002 (Journal of Laws No. 144, item 1204, as amended); the Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended); the Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended), European Union law, in particular the GDPR and other generally applicable provisions of law.
