What is the legal basis for processing the Client's personal data?

The legal basis for the processing of personal data of customers in the scope of data necessary to execute orders and consider complaints or other claims or competition participants by the Administrator is Article 13 paragraph 1 and paragraph 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR").

The user has the right to access their personal data and the right to rectify, delete, request the restriction of their processing, the right to transfer data, the right to object to their processing, the right to withdraw consent to processing at any time, which does not affect the lawfulness of processing based on consent before its withdrawal.

The consequence of withdrawing consent to the processing of personal data will be the inability to provide the service within the Amber 77 store and to process orders.

Providing personal data is voluntary, but it is a contractual condition necessary to use the services provided by Amber 77 within the Store. Refusal to consent to the processing of the User's personal data by Amber 77 will result in the inability to use the services provided within the Store and to fulfill orders.

By completing the Order/Registration form, the Buyer declares that the data provided therein is consistent with the facts.

The categories of Personal Data that will be processed by Amber 77 are:

username, e-mail address, telephone number, first and last name, postal address, geographical location, technical data about the devices used to access the Account, data about the internet and/or network connection (including IP address), mobile device identifier, operating system type, type of browser or other software, hardware data or other technical details provided by the browser, measurement data about the time and manner of use of the Account, current status, purchase history and selected links, preferences and choices, preferred language and currency, payment information including payment method, payment platform, type of transaction.

For what purposes are your personal data processed?

  • provision of the service and maintenance of documentation required by law Art. 6 sec. 1 letters b, c;
  • considering submitted complaints or other claims against the Data Controller. Investigation by the Controller against the Client/Consumer of any claims related to the contract.
  • fulfilling the legal obligations incumbent on the Administrator, e.g. in the field of tax law, accounting regulations (legal basis: Art. 6 sec. 1 c GDPR);
  • a situation arising from legally justified interests pursued by the Controller, e.g. in order to ensure e-mail or telephone contact, to confirm or cancel a service, as well as in the scope of the use of direct marketing and the determination, pursuit or defence of possible claims (legal basis: Art. 6 sec. 1 bif GDPR).
  • Depending on the situation, there may be other grounds listed in Articles 6 and 9 of the GDPR legalizing the processing of personal data by the Controller.

Personal data contained in the Seller's database are not transferred to entities not participating in the execution of the goods sale agreement.

In connection with the provision of services, personal data may be disclosed to external entities, in particular suppliers responsible for the operation of IT systems used to execute orders, entities such as banks and payment operators, entities providing accounting, legal and tax services, and couriers.

The data of individual Customers of the Amber 77 Store may be made available to entities authorized to receive them under applicable law, e.g. judicial authorities.

The User's personal data are processed for the duration of the Account and immediately deleted in the event of its liquidation. The data processing period may be extended if processing is necessary to establish, pursue or defend against potential claims in court, administrative or other extrajudicial proceedings, as well as at the request of competent public authorities, and after this period, only in the case and to the extent required by law. After the processing period, the data are irreversibly deleted.

By using the Store, the User agrees to the storage of cookies. Information collected using them is not used for advertising purposes, but only to increase the user's convenience and for purely technical purposes, e.g. maintaining the user's session, so that, for example, after going to the next page you do not have to log in again, the basket is not emptied and you can make purchases. The Administrator guarantees the fulfillment of all rights resulting from the GDPR and to the extent indicated therein, i.e. the right to access, rectify, limit the processing of personal data, the right to transfer them, not to be subject to automated decision-making, including profiling, as well as the right to object to the processing of personal data. However, the right to delete data, i.e. the right to be forgotten, is not an absolute right and is limited to the extent indicated in art. 17 sec. 3 of the GDPR (the exception concerns, among others, data necessary to determine, pursue or defend claims).

The Administrator does not currently use automated decision-making, including profiling.

In accordance with the requirements of the GDPR, the Administrator informs you about your right to lodge a complaint with the supervisory authority in connection with the processing of personal data (President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).

The information collected is used to increase the user's convenience and for purely technical purposes, such as maintaining the User's session. Creating a Cookie file does not violate the Client's privacy in any way. The information contained in it can only be used by our website. It is possible to change the appropriate settings in your browser and disable the ability to accept cookies.

Using the functionalities provided by these plugins, the Customer may recommend individual content or share it on a given social networking site. We inform you that by using these plugins, the customer exchanges data between a given social networking site. The amber77.com administrator does not process this data and does not have knowledge of what data is collected by these sites. Therefore, it is suggested to familiarize yourself with the regulations and privacy policies of the owners of these social networking sites before using a given plugin.
