GENERAL INFORMATION

 

Regulations of the Amber 77 online store define the conditions and rules for the implementation of orders placed via the website https://www.amber77.com operated by Amber 77 Anna Piwoni-Piórewicz with its registered office at Limbowa 9, Gdynia 81-520, Poland, VAT number PL9581531671, REGON 388746641.

The seller may communicate with the customer, and the customer with the seller via e-mail ([email protected]) or by post: Amber 77 Anna Piwoni-Piórewicz, Limbowa 9, 81-520 Gdynia, Poland.

The condition of ordering the goods and conducting the sale transaction is filling the order form and accepting the Terms and Conditions.

The subject of sale are the goods presented by the seller on the store’s website https://www.amber77.com at the time of placing the order. All goods presented in the e-store are new, unused and free from defects. The seller reserves the right to change the price of the goods, enter and withdraw the goods, grant discounts on particular goods and carry out and cancel promotions. However, these changes do not apply to orders that have been placed before. The seller’s offer in the e-store is valid throughout the world.

The prices of the goods presented in the e-store include VAT. The price given in the order form is binding at the time of placing the order.

 

PLACING ORDERS

 

The customer may place orders in the e-store 24 hours a day, 7 days a week via the website https://www.amber77.com. Orders placed on non-working days will be executed on the first working day following the day on which the order has been placed.

Placing an order constitutes submission by the buyer in relation to the seller an offer to conclude a sales agreement for the goods being the subject of the order. The contract is concluded at the time of sending the customer an e-mail with confirmation of acceptance of the order.

The seller is not responsible for the failure to deliver an e-mail about placing an order for reasons beyond the control of https://www.amber77.com.

The customer should pay the order together with the delivery costs within 7 calendar days from the moment of concluding the sales contract. After this date, the seller’s offer is not binding.

Modification or deletion of the order is possible until the order has not yet been sent. The customer can make the above activities through contact with the seller. This does not in any way affect the consumer’s right to withdraw from the contract within 7 days of receipt of the goods.

 

 

ORDER FULFILMENT

 

The condition for the implementation of the order placed by the customer is to provide real personal and contact data when completing the Order Form (enabling verification and confirmation of the order).

In the event that the order form is insufficiently or incorrectly completed by the customer, the seller will try to contact the customer to confirm the order. If the submission of the order can not be confirmed within 7 days due to the lack of contact with the buyer, the seller’s offer is not binding.

 

PAYMENT

 

The seller provides the following payment methods:

  • Settlement of transactions by credit card and e-transfer carried out via PayPal.
  • Payment by a traditional transfer to the seller’s bank account.

All transfer costs are covered by the sender of the transfer.

COST, TIME AND METHODS OF DELIVERY

 

Information about delivery costs is visible during the ordering procedure. Delivery costs are added to the price of the goods and are borne by the customer.

The Seller realises the delivery of the ordered goods free of charge via Polish Post for orders over 200 euro.

The goods are shipped within 3 business days from the moment the payment is credited to the seller’s account. In the case of prolonging the delivery time, the seller is obliged to contact the customer.

The average duration of the contract with delivery is four business days. Outside the country, the delivery time is usually between 7 and 14 business days.

The buyer must pay all customs and import taxes, if any. Seller is not responsible for delays caused by customs procedures.

When collecting a parcel delivered by a courier or post, the buyer is obliged to examine it (pursuant to Article 545 § 2 of the Civil Code). In the event of damage to the parcel, the seller recommends to make a damage report in the presence of the supplier and to inform the seller immediately. The absence of a parcel damage protocol may make it difficult for the consumer to pursue possible claims from the seller and to determine the person responsible for the damage to the parcel.

Seller is not responsible for delays in the delivery of goods ordered, if the delays arose due to reasons attributable to the provider of courier services.

If the shipment does not reach the addressee due to an incorrect or incomplete address of the recipient (also if the company delivering the shipment considers the given address to be insufficient or incorrect), all costs related to delivery (including re-delivery) are borne by the customer.

 

GUARANTEE AND COMPLAINT

 

Seller is obligated to provide the customer with goods free from defects.

The customer, due to a defect of the goods, has the right to lodge a complaint. If, after receiving the purchased item, the customer finds defects in it, he should immediately contact the seller.

The complaint may be submitted in writing to the following address: Amber 77 Anna Piwoni-Piórewicz, Limbowa 9, 80-520 Gdynia, Poland.

When submitting a complaint, the seller recommends providing the customer’s contact details, the name of the item and a detailed description of the causes of the complaint and demands to the seller, as well as attaching the sales document, and damaged item.

Complaints submitted by the customer are considered within 14 business days of their receipt.

Goods with a defect may be repaired or replaced by seller. Seller may refuse to satisfy the consumer’s request if it is impossible to comply with the Defective Goods Agreement in a manner chosen by the consumer, or it may require excessive costs compared to the second possible way to bring things into conformity with the contract.

If it is not possible to repair the goods, the buyer will receive the value of the goods.

The seller covers the shipping costs related to the complaint, both from the customer to the seller and vice versa in the amount corresponding to the one selected in the order.

 

WITHDRAWAL FROM THE AGREEMENT

The customer may withdraw from the sale agreement without giving a reason within 7 calendar days from the date of receipt of the goods.

This statement should be sent via email [email protected] and the returned order should be sent back (no later than 7 calendar days from the receipt of the parcel) to the following address: Amber 77 Anna Piwoni-Piórewicz, Limbowa 9, 80-520 Gdynia, Poland.

The costs of returning the goods are borne by the buyer returning the goods.

The seller withholds the refund until receiving of the returned goods and consideration of resignation contract. Seller has 7 business days to consider the resignation contract. If the answer is positive, the refund will be made within 1 business day.

In the event of withdrawal from the contract, the customer is obliged to return the item unchanged. The customer is responsible for the reduction of the value of the item.

The receipt should be sent back with the goods. If the proof of purchase is an invoice, the buyer is obliged to attach the signed correction invoice.

 

PERSONAL DATA PROTECTION

 

The legal basis for the processing of personal data of clients in the scope of data necessary to execute orders and handling of complaints or other claims or participants of the competition by the Controller is art. 6 para. 1 b) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (”GDPR”).

FINAL DECISIONS

 

Contracts concluded through the Amber 77 store are concluded in accordance with Polish law. In matters not covered by the Terms and Conditions, the decisions of the generally applicable law shall apply, including in particular the decisions of the Civil Code and the Act of 30 May 2014 on Consumer Rights. The Terms and Conditions do not exclude or limit any rights of the consumer that he/she is entitled.

The name of the e-store Amber 77, the address at which it is available: www.amber77.com and all materials contained therein, including logo and photographs, are subject to copyright and are protected by law. Using and distributing them without the consent of the e-store owner is prohibited.
